Terms of Service

The short version

  • zenfiusa.com is a marketing and education platform. We are not a lender, broker, or bank.
  • Everything on the site is illustrative. Nothing is a loan offer, quote, or commitment.
  • If you ask us to, we'll connect you with an independent licensed mortgage broker. What happens between you and that broker is between the two of you.

1. Who we are

These terms are between you and ZenFi Inc., a Delaware corporation with operations in California ("ZenFi," "we," "us," "our"). By using zenfiusa.com, you agree to these terms. If you don't agree, please don't use the site.

2. What this site is (and isn't)

zenfiusa.com is an educational platform. We explain how cash-out refinancing works, show illustrative scenarios, provide a simple savings estimator, and offer to connect you with a licensed mortgage broker who can actually handle a refinance.

We are not:

  • A bank or lender.
  • A mortgage broker or loan originator.
  • Licensed to give you individual financial, legal, or tax advice.
  • A guarantor of any loan, rate, or outcome.

3. Nothing on this site is an offer or a commitment

Every number, scenario, calculator result, and example on zenfiusa.com is illustrative. It is not:

  • A loan offer.
  • A Loan Estimate (the regulated document you'd receive from a broker or lender).
  • A guarantee of any rate, term, payment, or savings.
  • Personalized financial advice.

Your actual loan terms, if you pursue one, come from the licensed broker based on your verified qualifications, credit, equity, and current market conditions.

4. Who the site is for

You must be at least 18 years old to use this site. Our qualification flow is designed for California homeowners considering cash-out refinancing. If you don't fit that profile, the site may still be useful to read, but we won't have a broker to connect you with.

5. Your responsibilities

When you use the site and submit the qualification form, you agree to:

  • Give accurate information to the best of your knowledge.
  • Use the site for your own personal inquiry. No scraping, reselling, automated submission, or bulk extraction.
  • Not impersonate another person or misrepresent your relationship with one.
  • Not attempt to interfere with the site's security, availability, or integrity.

6. The broker relationship

When we connect you with a licensed mortgage broker in the ZenFi Network (currently Victor Martinez / Victory Home Mortgage, California DRE Broker License #01764042, NMLS #463448, Company NMLS #1866428), that broker is an independent business.

The broker is not our employee, agent, or representative. Their conduct, their quotes, their loan terms, and their own privacy practices are governed by their license, their direct agreement with you, and applicable state and federal law.

We vet the brokers we work with against our own standards for transparency and client-first service. But we are not legally responsible for any broker's actions, representations, or loan products.

7. Our content

The copy, layout, illustrations, scenarios, and calculator logic on this site are the property of ZenFi Inc. You may share links to any public page. You may not copy, reproduce, translate, or create derivative works from our content without written permission.

8. Disclaimers

We work to keep the site accurate and available, but we don't promise it will be:

  • Perfectly accurate at every moment (mortgage rates and rules move).
  • Available without interruption.
  • Free of errors, bugs, or defects.

The site and all its content are provided "as is" and "as available" without warranty of any kind, express or implied. To the extent allowed by law, we disclaim all implied warranties including merchantability, fitness for a particular purpose, and non-infringement.

9. Limit on our liability

To the fullest extent California law allows, ZenFi Inc. is not liable to you for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the site or your interaction with any broker we connect you with.

Our total aggregate liability to you, for any claim arising from these terms or your use of the site, is limited to one hundred U.S. dollars ($100) or the amount you paid us in the twelve months before the claim, whichever is greater. (You do not pay us — the site is free for homeowners.)

10. Indemnification

You agree to defend, indemnify, and hold ZenFi Inc. harmless from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of (a) your breach of these terms, (b) your misuse of the site, or (c) your violation of any applicable law or third-party right.

11. Arbitration and class action waiver

Any dispute between you and ZenFi Inc. that arises out of or relates to these terms or your use of the site will be resolved by binding individual arbitration under the Federal Arbitration Act, administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitrator's decision is final and enforceable in any court of competent jurisdiction.

You waive the right to participate in a class action, class arbitration, or representative proceeding. Disputes must be brought individually.

Opt-out. You can opt out of this arbitration clause by emailing legal@zenfiusa.com within 30 days of first using the site, with the subject line "Arbitration Opt-Out" and your full name. If you opt out, the rest of these terms still apply, and disputes go to court in California (see Section 12).

12. Governing law and venue

These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute not subject to arbitration (for example, if you timely opted out) will be resolved exclusively in the state or federal courts located in Los Angeles County, California. You consent to that venue.

13. Changes to these terms

We may update these terms from time to time. We'll update the "Effective" date at the top and, for material changes, post a notice on the homepage for at least 30 days before the change takes effect. Your continued use of the site after a change means you accept the updated terms.

14. Other

  • Severability. If any part of these terms is found unenforceable, the rest stays in force.
  • No waiver. If we don't enforce a term, that doesn't mean we've waived our right to enforce it later.
  • Assignment. You can't assign these terms without our consent. We can assign them to a successor in connection with a merger, acquisition, or sale of assets.
  • Entire agreement. These terms and our Privacy Policy are the entire agreement between you and us regarding the site.
